O direito na era digital: Uma perspectiva brasileira e portuguesa

Abstract

Objetiva-se a partir desta tese provar para sociedade que o novo mundo virtual jamais será seguro, afinal depende do homem e suas habilidades, assim como o mundo real, o próprio ser humano é algo indecifrável, mas podemos minimizar o lado ruim desta nova era digital, através de novas armas jurídicas, ou seja, antídotos, remédios jurídicos no âmbito universal. Como metodologia foi realizado um estudo bibliográfico sobre a evolução do Direito e a segurança jurídica no Direito digital, como por exemplo a nova tecnologia Blockchain e seus reflexos no Direito, considerando os casos de Brasil e Portugal, buscando em livros e artigos embasamento para discussão sobre o assunto, bem como no Ordenamento Jurídico de ambos os países. Ao final deste estudo verificouse que o Direito Digital tanto no Brasil quanto em Portugal ainda está numa fase latente e que necessita de muitos avanços. Assim, deve-se o ordenamento jurídico brasileiro e português focar em questões como a proteção aos dados pessoais na internet, identificar condutas informáticas que podem se caracterizar como crimes virtuais e averiguar a tipificação de crimes virtuais com mais clareza e eficácia. Todavia, alerta-se que esse ambiente nunca vai estar totalmente seguro, sempre com novas ameaças que vão surgir com o avançar da história, com o Direito precisando acompanhar e evoluir nos mesmos passos para que seja possível mitigar esses riscos.

The objective of this thesis is to prove to society that the new virtual world will never be safe, after all it depends on man and his abilities, just like the real world, the human being is something indecipherable, but we can minimize the bad side of this new era digital, through new legal weapons, that is, antidotes, legal remedies in the universal scope. As a methodology, a bibliographic study was carried out on the evolution of Law and legal security in digital Law, focusing on issues related to the use of Blockchain and its reflexes in Law, considering the cases of Brazil and Portugal, searching in books and articles for discussion on the subject, as well as in the Legal Order of both countries. At the end of this study it was possible to verify that Digital Law in both Brazil and Portugal is still in a latent phase and that many advances are needed. Thus, Brazilian and Portuguese legal systems should focus on issues such as the protection of personal data on the internet, identify computer conducts that can be characterized as virtual crimes and investigate a classification of virtual crimes more clearly and effectively. However, it is warned that this environment will never be completely safe, always with new recoveries that will emerge with the advancement of history, with the Law needing to follow and evolve in the same steps so that it is possible to mitigate these risks.
