Registos e notariado: que situação actual e que perspectivas?

Abstract

Procuramos resumir a actual situação em Portugal no domínio dos registos – sobretudo no tocante aos registos civil, predial e comercial – assim como no do notariado. Referimos em síntese as últimas reformas legislativas nestas matérias e tentamos perspectivar a sua evolução futura, tendo feito a este propósito algumas sugestões que se afiguram justas e oportunas. A respeito do registo predial e tendo sobretudo em atenção a hodierna fragilidade dos títulos, bem como a da posse, propusemos que se consignasse o efeito constitutivo do registo, sobretudo para salvaguarda dos contratantes e para a defesa do comércio jurídico imobiliário.

We try to resume the actual situation in Portugal about the Registrations – those that are made in civil, commercial and land register institutions – as well as of the notarial acts. W e also try to condense the last reforms of the legislation on those matters and finally to perspective its future evolution. At this purpose we intent to suggest the constitutive effect in the land registry in order to improve the security of the property rights, the faith and defence of the contracting parties and also the protection of the property market.
