Breves notas em torno da caducidade da convenção arbitral e da extinção do poder jurisdicional dos árbitros.

Abstract

A caducidade da convenção arbitral pelo decurso do prazo para a tomada da decisão arbitral, fixado a título supletivo pelo n.º 3 do artigo 19.º da Lei de Arbitragem Voluntário, de 6 meses contados da data da designação do último árbitro, ou seja, da data de constituição do tribunal arbitral: a determinação do momento do início do prazo. E a consequência do decurso desse prazo ou de outra ocorrência que ponha termo à convenção arbitral, nomeadamente o seu cumprimento, através tomada da decisão arbitral, no que respeita aos poderes dos árbitros.

The expiration of the arbitration convention for the ending of the period for arbitral decision, fixed supplementary by the n.º 3 of the article 19 of the Voluntary Arbitration Law, of 6 months counted from the date of designation of the last referee, in other words, counted from the date of the creation of the arbitral tribunal: determinate the start time of the deadline. And the consequence of that term or other event that terminate the arbitration convention, namely the fulfillment, trough the making of the arbitral decision, regarding the referee powers.
